On December 29, 2022, the Fourth Court of Appeals in San Antonio, Texas, issued an order regarding the appeal of Terrick L. Alsbrooks against Cherish Realty Solutions LLC and others. The trial court clerk informed the appeals court that the clerk’s record was not filed due to Alsbrooks' failure to pay the necessary fee for its preparation. The order mandates that Alsbrooks must provide written proof within ten days that either the clerk’s fee has been paid or arrangements have been made to pay it, or that he is entitled to appeal without the fee. Failure to comply may result in the dismissal of the appeal for lack of prosecution, in accordance with TEX. R. APP. P. 37.3(b). The order is signed by Chief Justice Rebeca C. Martinez and the court clerk, Michael A. Cruz.
