Mickler v. Mickler
Docket: Nos. 06-5986, 06-5987
Court: Court of Appeals for the Sixth Circuit; December 5, 2007; Federal Appellate Court
Appellant Andrew S. Mickler appeals the district court's July 11, 2006, judgment that upheld the bankruptcy court's April 20 and 25, 2005, orders. These orders declared Mickler's debts from his divorce with appellee Terry J. Mickler as nondischargeable under Chapter 11 of the Bankruptcy Code. Additionally, the bankruptcy court barred Mickler from refiling a Chapter 11 petition for 24 months and dismissed his cases due to bad faith in filing the petition. After reviewing the record and relevant law, the court finds no errors in the bankruptcy court's factual findings or legal conclusions. The dismissal for cause under 11 U.S.C. § 1112(b) was not an abuse of discretion. Consequently, the district court's decision is affirmed based on the well-reasoned opinions of both the district and bankruptcy courts.
