On November 17, 2022, the Court of Appeals for the First District of Texas issued a memorandum opinion regarding the appeal of Tristan Thompson against Maralee Nichols, stemming from the 507th District Court in Harris County, Texas (Case No. 2021-43397). Thompson filed a notice of appeal on March 1, 2022, contesting a trial court order from December 16, 2021, which granted dismissal. On October 14, 2022, Thompson submitted an unopposed motion to dismiss the appeal based on a settlement agreement between the parties. He requested that the court dismiss the appeal, order each party to bear their own costs, and mandate immediate issuance of the dismissal. The motion included a certification indicating that Nichols did not oppose the requested relief. The court granted Thompson's motion, dismissing the appeal in accordance with Texas Rules of Appellate Procedure (TEX. R. APP. P. 42.1(a)(1)). It ordered that costs be taxed against the party that incurred them and directed the Clerk to issue the mandate immediately. All other pending motions were dismissed as moot. The panel consisted of Justices Goodman, Hightower, and Guerra.
