Hardie’s Fruit and Vegetable Company-South, LP (Hardies) filed a motion to dismiss an appeal on the grounds of mootness and sought to vacate a judgment from the Court of Federal Claims dated September 15, 2008, as well as a decision from the Small Business Administration’s Office of Hearings and Appeals dated July 15, 2008. The United States opposed Hardies’ request to vacate the judgments. The court granted the motion to dismiss the appeal and denied the motion to vacate the prior judgments. A mandate will be issued in due course.
