Docket: No. 07-71710

Court: Court of Appeals for the Ninth Circuit; October 13, 2009; Federal Appellate Court

Ricardo Lozano Ortiz, a Mexican national, filed a pro se petition seeking review of the Board of Immigration Appeals' (BIA) denial of his cancellation of removal application. The BIA determined that Ortiz did not provide sufficient evidence to demonstrate the required hardship to his lawful permanent resident wife and their U.S. citizen children. The court lacks jurisdiction to review the BIA’s discretionary determination regarding the hardship evidence. Accordingly, the petition for review is dismissed. This decision is not intended for publication and does not serve as precedent, except as specified by 9th Cir. R. 36-3.
