Canterbury v. J.P. Morgan Mortgage Acquisition Corp.
Docket: No. 13-2083
Court: Court of Appeals for the Fourth Circuit; March 26, 2014; Federal Appellate Court
Stephen J. Canterbury appeals the dismissal of his complaint by the district court, which sought a declaratory judgment regarding his right to rescind a refinance credit transaction under the Truth in Lending Act (TILA). Specifically, Canterbury sought enforcement of this rescission and a modification of the timing of tender as prescribed by TILA. Upon review, the appellate court found no reversible error in the district court’s order and affirmed the dismissal. The court noted that oral argument was unnecessary as the facts and legal issues were sufficiently presented in the submitted materials. The opinion is unpublished and serves as non-binding precedent in the circuit.
