The Michigan Supreme Court, in an order dated October 14, 2005, addresses the case between National Wine Spirits, Inc., National Wine Spirits, L.L.C., and NWS Michigan, Inc. as plaintiffs-appellants against the State of Michigan as defendant-appellee, with the Michigan Beer and Wine Wholesalers Association as an intervening defendant-appellee. The court previously held the application for leave to appeal in abeyance pending the outcome of Granholm v. Heald, a significant case decided by the U.S. Supreme Court. Following the issuance of the Granholm opinion on May 16, 2005, the Michigan Supreme Court reconsiders the application for leave to appeal the Court of Appeals' judgment from March 25, 2004. The court orders the scheduling of oral argument to determine whether to grant the application or take other permitted actions. Additionally, parties may submit supplemental briefs within 28 days, with a caution against merely restating previously made arguments. The motion to strike is denied as moot.
