Sever v. CEO of Prisoner Transport America
Docket: No. 10-7740
Court: Court of Appeals for the Fourth Circuit; April 6, 2011; Federal Appellate Court
Ronald D. Sever's appeal of the district court's dismissal of his 42 U.S.C. § 1983 action was affirmed by a PER CURIAM opinion, which noted that unpublished opinions do not serve as binding precedent in the circuit. The district court dismissed Sever's case for failure to state a claim following a review under 28 U.S.C. § 1915(e)(2)(B). Sever's request for appointment of counsel was denied after a thorough review of the record revealed no reversible error. The court determined that oral argument was unnecessary as the relevant facts and legal issues were sufficiently presented in the written materials. The dismissal was affirmed.
