Poux v. FCI Bennettsville SC
Citation: 418 F. App'x 157Docket: No. 10-7675
Court: Court of Appeals for the Fourth Circuit; March 18, 2011; Federal Appellate Court
Ernesto Poux, Jr. attempted to appeal a district court order from November 19, 2010, that granted the defendants' motion to stay discovery. The appellate court clarified that it only has jurisdiction over final orders and certain interlocutory or collateral orders as defined under 28 U.S.C. 1291 and 28 U.S.C. 1292. The court emphasized that the order Poux sought to appeal did not qualify as either a final order or an appealable interlocutory or collateral order. As a result, the appeal was dismissed for lack of jurisdiction. The court also determined that oral argument was unnecessary since the relevant facts and legal arguments were sufficiently presented in the documents.
