Liberty Mutual Fire Insurance Company and Liberty Mutual Insurance Company (collectively referred to as Liberty) appealed the dismissal of their declaratory judgment action against Travelers Indemnity Company of Illinois (Travelers). The district court dismissed the case under Fed. R. Civ. P. 12(b)(1), determining it lacked subject matter jurisdiction because Liberty failed to demonstrate the existence of an “actual controversy” between the parties. Upon reviewing the jurisdictional issue de novo, the appellate court affirmed the district court's dismissal, agreeing with its reasoning and finding Liberty's arguments on appeal to be without merit. The judgment of the district court is therefore affirmed.
