Court: Court of Appeals for the Ninth Circuit; August 19, 2004; Federal Appellate Court
Apolinar Montez Hernandez-Miramontes appeals his guilty plea and 63-month sentence for methamphetamine distribution under 21 U.S.C. § 841. His counsel has submitted an Anders brief indicating no grounds for relief and has also requested to withdraw from representation. Hernandez-Miramontes filed a pro se supplemental brief. After reviewing the submitted briefs and the case record, no grounds for direct appeal relief were found. Consequently, the court grants the motion for counsel to withdraw and affirms the district court’s judgment. The decision is not for publication and is subject to Ninth Circuit Rule 36-3 regarding citation limitations.
