Veronica Lucarelli appealed the dismissal of a 28 U.S.C. § 2241 habeas corpus petition filed on behalf of her husband, Ronald Lucarelli, who is imprisoned. Ronald pleaded guilty to conspiracy to distribute cocaine in 2000 and was sentenced to 168 months in prison, without filing a direct appeal. After his 2001 motion to vacate his sentence under 28 U.S.C. § 2255 was denied, Mrs. Lucarelli filed the habeas petition in 2002, claiming her husband had no privileges under a specific statute concerning debt payment through intangibles.

The district court dismissed the petition, stating that one pro se litigant cannot represent another and that there was insufficient evidence to show that the § 2255 remedy was inadequate or ineffective. Upon appeal, the reviewing court found that Mrs. Lucarelli lacked standing as a "next friend" to file the petition. To qualify, a next friend must provide a valid reason for the real party's inability to represent themselves, demonstrate a significant relationship, and act in the best interests of that party. The court concluded that Mrs. Lucarelli did not demonstrate that her husband was unable to access the courts or was incompetent, leading to the affirmation of the district court’s judgment.
