Ex Parte Shawn Paul Robinson
Citation: Not availableDocket: 01-22-00583-CR
Court: Court of Appeals of Texas; October 18, 2022; Texas; State Appellate Court
Original Court Document: View Document
Appellant Shawn Paul Robinson appealed the trial court's denial of his application for a writ of habeas corpus. The appellate record was submitted, and the Court ordered briefs to be filed by September 7, 2022. Appellant failed to submit his brief, prompting the Court to notify him on September 20, 2022, that the appeal would be abated unless a brief was filed within ten days. After no brief was filed, the Court abated the appeal on October 6, 2022, and remanded the case for a hearing to determine the reasons for the delay. On October 12, 2022, appellant’s counsel submitted the brief along with a motion to accept the late filing and reinstate the appeal. The Court granted the motion, reinstating the case on the active docket and accepting the brief as filed. Consequently, the previously ordered hearing was deemed unnecessary, and the requirements for supplemental records were canceled. The State was instructed to file its brief by November 1, 2022. The order was signed by Acting Judge Amparo Guerra on October 18, 2022.
