The Michigan Supreme Court issued an order on January 31, 2008, regarding the case of Lawrence Eugene Dell (Plaintiff-Appellant) against the St. Clair Circuit Court (Defendant-Appellee). The court denied the motion to waive fees based on MCL 600.2963, which mandates that prisoners pursuing civil actions are responsible for filing fees. The plaintiff is required to pay an initial partial filing fee of $7.00 within 21 days of the order's certification and must submit a copy of the order along with the payment. Additionally, the plaintiff must refile the pleadings that are being returned with the order.

Failure to comply will result in the appeal not being filed. If the fee and pleadings are submitted on time, the plaintiff must make monthly payments to the Department of Corrections amounting to 50 percent of any deposits made to his account until the total balance of $368.00 is paid. The plaintiff is prohibited from filing further appeals in this Court until the entry fee is fully settled. The Clerk of the Court is instructed to provide two copies of the order to the plaintiff and return the pleadings. The order is certified as a true and complete copy by the Clerk of the Michigan Supreme Court.
