Murray v. A Cab Taxi Serv. Llc
Docket: 84888
Court: Nevada Supreme Court; October 17, 2022; Nevada; State Supreme Court
Original Court Document: View Document
The Supreme Court of Nevada has dismissed an appeal involving Michael Murray and others against Mile A Cab Taxi Service LLC and related parties. The appeal stemmed from district court orders regarding costs, with the appellants challenging a June 3, 2022, order that was found to be non-substantive and duplicative of a prior May 17, 2022, order. The court noted that the June 3 order did not introduce new information regarding the cost award, rendering it superfluous and therefore not appealable. Additionally, the notice of appeal for the May 17 order was deemed prematurely filed, as it occurred after a tolling motion was submitted on May 31, 2022, but before the district court had issued a final ruling on that motion. The court referenced NRAP 4(a)(4) regarding the tolling effect of post-judgment motions and concluded that because the tolling motion remained pending, it lacked jurisdiction over the appeal. Consequently, the court ordered the dismissal of the appeal.
