On November 21, 2011, the Michigan Supreme Court, presided over by Chief Justice Robert P. Young, Jr. and Justices Michael F. Cavanagh, Marilyn Kelly, Stephen J. Markman, Diane M. Hathaway, and Mary Beth Kelly, issued an order regarding the case involving Whitesell International Corporation as the plaintiff and William Whitaker as the defendant, along with MRC Industrial Group, Inc. and Piercetek, Inc. as additional defendants. The Court granted motions for miscellaneous relief but denied the applications for leave to appeal the January 18, 2011 judgment of the Court of Appeals and for cross-appeal or peremptory reversal. The Court concluded that the questions presented did not warrant review. Justice Brian K. Zahra did not participate in the case due to his prior involvement on the Court of Appeals panel.
