Cheri subsequently filed a motion on August 14, 1984, to vacate the stay. The Court denied this motion, opting to maintain the stay until the Patzers’ appeal is resolved. The Court expressed concerns regarding the wisdom of altering the existing custody arrangement, noting that Steven has been in the Patzers’ physical custody for nearly his entire five-year life. The motion to vacate the stay was denied, with concurrence from Chief Justice Erickstad and Justices Pederson, Vande Walle, and Sand.
