On August 22, 2022, the Court of Appeals for the Fifth District of Texas issued an order concerning the appeal of Seven Thousand Eight Hundred Ninety Dollars in United States Currency against the State of Texas, originating from the 193rd Judicial District Court of Dallas County. The appellant filed a motion for an extension of time to submit a motion for rehearing, citing a lack of notice regarding the court's June 29, 2022 dismissal opinion due to an incorrect email address on file. The court confirmed that the email address was indeed incorrect but has since been corrected. Consequently, the court granted the appellant's request for an out-of-time motion for rehearing, allowing the motion submitted on August 18, 2022, to be filed as of the date of the order. However, the court denied the appellant's motion for rehearing. On its own motion, the court vacated the prior opinion and judgment from June 29, 2022, thereby reinstating the appeal. The appellant is now required to submit his brief within thirty days of the order, with a warning that failure to do so may lead to dismissal of the appeal without additional notice.
