The Court of Appeals for the Second Appellate District of Texas reviewed the case of Tonya Gayle Harkins versus Wal-Mart Stores Texas, LLC. The court denied the Appellees' motion for rehearing and withdrew its previous opinion dated June 23, 2022, replacing it with a new judgment. 

The court affirmed the trial court’s no-evidence summary judgment concerning Harkins' claim of liability against the Appellees for negligent activity. However, it reversed part of the trial court's summary judgment and remanded the case for further proceedings regarding other claims. Each party is ordered to bear their own costs of the appeal. Justice Mike Wallach signed the memorandum opinion.
