In 2005, the Florida Supreme Court approved two indigent status application forms developed by the Florida Clerks of Court Operations Corporation: the Application for Determination of Civil Indigent Status and the Application for Criminal Indigent Status, as per statutory provisions. Following this approval, the Court allowed a 60-day period for public comment, during which feedback was received from various legal committees and Florida Legal Services. In response, the Clerks Corporation submitted a revised Civil Indigent Status application form, which the Court has now approved and authorized for publication. The revised form maintains the provision allowing nonlawyers to assist individuals in completing it, with the stipulation that only clerks of court and contracted third parties may provide such assistance. The Court makes clear that its approval does not imply any endorsement of the form’s correctness or applicability. The revised form is effective immediately upon the release of this opinion and is available for access and download from both the Florida Supreme Court and Florida State Courts websites. No revisions were made to the Application for Criminal Indigent Status, as it did not receive any comments. The Court asserts its jurisdiction over the matter as outlined in the Florida Constitution and Bar regulations.
