Jesse v. Commercial Diving Academy of Jacksonville, Inc.
Docket: No. 1D06-6260
Court: District Court of Appeal of Florida; August 14, 2007; Florida; State Appellate Court
Appellant's personal injury action was dismissed with prejudice due to a finding that he intentionally provided false testimony on a material issue during discovery. The court reviewed the case under an abuse of discretion standard and determined that the trial court's factual findings were supported by competent substantial evidence. The evidence convincingly demonstrated that the appellant did indeed testify falsely. Consequently, the appellate court affirmed the trial court's decision, holding that dismissing the action with prejudice was an appropriate sanction for the appellant's conduct. Judges Webster, Lewis, and Thomas concurred.
