The Alabama Circuit Court's summary denial of Earl Fitzgerald Webb's Rule 32 petition for post-conviction relief is reversed based on the precedent set in Ex parte Webb, 843 So.2d 127 (Ala. 2002). The case is remanded with instructions for the circuit court to grant Webb relief by vacating his conviction and sentence for first-degree burglary. The decision was reached with the concurrence of Judges McMillan, Cobb, Baschab, and Wise. Additionally, this case was reassigned to Judge Shaw following its remand from the Alabama Supreme Court.
