Barge appeals his sentences under the Prison Releasee Reoffender Act and both the habitual violent felony offender and habitual felony offender statutes. The court affirms that imposing equal, concurrent sentences under these statutes does not breach double jeopardy principles; however, it does contravene the provisions of the Prison Releasee Reoffender Act itself. Citing precedent from Grant v. State and other relevant cases, the court vacates the district court's decision and remands the case for reconsideration in light of these rulings. The opinion is concurred by Chief Justice Wells and Justices Shaw, Harding, Anstead, Pariente, and Quince.
