Appellant challenges the trial court's March 30, 2000 order that denied a motion to correct an illegal sentence based on Heggs v. State. The trial court ruled that the December 1996 crime did not fall within the established window for Heggs claims, referencing Bortel v. State. However, the Florida Supreme Court later clarified the window period for such challenges in Trapp v. State, determining it spanned from October 1, 1995, to May 24, 1997, which includes the date of appellant’s crime. Consequently, the appellate court reverses the trial court's decision and remands the case for consideration of the merits of the appellant’s motion. Chief Judge Warner and Judges Gunther and Farmer concur with the decision.
