Ospina v. Security National Insurance
Docket: No. 98-2310
Court: District Court of Appeal of Florida; June 30, 1999; Florida; State Appellate Court
Final summary judgment was appropriately granted by the trial court in favor of Security National Insurance Company. It is established law that an insurance broker typically acts as the agent for the insured. In this case, there was no evidence indicating that the insurance company led the insured to believe that the broker had actual or apparent authority as its agent. Consequently, the notice provided to the broker regarding the insured's acquisition of a replacement vehicle did not suffice to impute knowledge to the insurance carrier. The judgment is affirmed.
