Hale v. Tharp
Docket: No. 94-1154
Court: District Court of Appeal of Florida; September 27, 1995; Florida; State Appellate Court
A dispute arose concerning a deed, property boundaries, and conflicting land surveys. The trial court's findings indicated that it did not determine the accuracy of either land survey. Despite this, the property transfer in the order relied on one of the surveys. The attorneys mistakenly believed a future decision could resolve which survey was correct. The court emphasized that resolving this issue is critical for determining appropriate relief. Consequently, the decision is reversed and remanded for further proceedings in line with this opinion. Justices BOOTH, MINER, and MICKLE concur.
