Dyck-O'Neal, Inc. v. Cislo
Citation: 262 So. 3d 882Docket: No. 1D17-2151
Court: District Court of Appeal of Florida; February 4, 2019; Florida; State Appellate Court
The Florida Supreme Court has quashed the previous decision and remanded the case for reconsideration based on its ruling in Dyck-O'Neal, Inc. v. Lanham, 257 So.3d 1 (Fla. 2018). Following the Supreme Court's directive, the appellate court reverses the trial court's dismissal order and remands the case for a determination of the merits of Dyck-O'Neal's deficiency claim. The decision to reverse and remand is concurred by Chief Justice B.L. Thomas and Justices Lewis and Makar.
