Simmons v. State
Docket: No. 93-02297
Court: District Court of Appeal of Florida; August 18, 1993; Florida; State Appellate Court
Randall Simmons appeals the summary denial of his motion under Florida Rule of Criminal Procedure 3.800(a), arguing that he is entitled to equal credit for presentence jail time for two concurrent prison sentences from separate cases, citing Daniels v. State, 491 So.2d 543 (Fla. 1986). The court is unable to determine the validity of the denial without additional records or attachments related to Keene v. State, 500 So.2d 592 (Fla. 2d DCA 1986). Consequently, the case is remanded for the trial court to either grant Simmons equal credit for presentence jail time or provide supporting documentation for its decision. Any party dissatisfied with the trial court's subsequent ruling must file a timely notice of appeal for further review. The decision is reversed and remanded. Judges CAMPBELL, THREADGILL, and PARKER concur.
