R. Carr Plumbing v. Bogue
Citations: 572 So. 2d 565; 1991 Fla. App. LEXIS 159; 1991 WL 2345Docket: No. 90-173
Court: District Court of Appeal of Florida; January 9, 1991; Florida; State Appellate Court
The employer and carrier appeal a workers’ compensation order that awarded the claimant medical benefits and temporary partial wage loss benefits. The appeal raises several issues, but the court finds only one meritorious: the lack of notice regarding the claim for temporary partial wage loss benefits. Consequently, the award for these benefits is reversed while the rest of the order is affirmed. The case involved claims for temporary total disability benefits following a December 23, 1988 accident and payment of medical bills. The claimant admitted he did not claim temporary partial wage loss benefits during the initial claim, pre-hearing conference, or final hearing. The court concludes the appellants did not receive adequate notice or opportunity to contest the temporary partial wage loss benefits before the award. The order is affirmed in part and reversed in part, and the case is remanded for further proceedings. Justices Wentworth, Joanos, and Allen concur.
