Ryan v. State
Docket: No. 90-00805
Court: District Court of Appeal of Florida; June 22, 1990; Florida; State Appellate Court
Roy Ryan appeals the denial of his motion to correct sentence, arguing that he should receive equal presentence jail credit against two concurrent 30-month sentences stemming from separate cases. He was awarded 201 days of credit in only one case. Citing Daniels v. State, Ryan contends that he is entitled to equal credit-time applied to both sentences. The trial court did not provide sufficient record evidence to refute his claim, leaving unresolved whether the Daniels ruling applies or if there are valid reasons for unequal credit. Consequently, the case is remanded for further proceedings, requiring the trial court to attach relevant documentation if it again denies Ryan's motion. Any party dissatisfied with the new decision has thirty days to appeal. The prior ruling is reversed.
