The Unemployment Appeals Commission's order reversing the appeals referee's decision regarding Sharon M. Gosha's discharge is challenged by the employer. The appeals referee had determined Gosha was discharged for misconduct related to her work, leading to her disqualification from unemployment benefits. The Commission, however, dismissed the referee's factual findings, which were backed by competent substantial evidence, and replaced them with unsuitable alternative findings. As a result, the Commission's order is reversed and remanded for the affirmation of the referee's initial decision. Judges Ervin and Wigginton concur with this ruling.
