The trial court's decision is affirmed in part and reversed in part concerning the case consolidated with Carroll v. Newtron, Inc. The motions for summary judgment filed by Fisher Controls, Inc. and E.B. Badger Sons Co., along with its successor, Stone and Webster Engineering Corporation, are granted, resulting in their dismissal from the case with prejudice. Conversely, the motions for summary judgment by Rosemount, Inc., Magnetrol International, Inc., Ronan, Inc., Moore Products Company, Newtron, Inc., S.I.P. Engineering, Inc., and Johnson Controls, Inc. are denied, allowing the plaintiffs, James Kenneth Hedrick, Jr. and all third-party plaintiffs, to proceed against these defendants. Additionally, Lena Diane Bruette Hedrick's action against all defendants is dismissed with prejudice. The court specifies that costs from the trial court and this appeal will await the final disposition of the matter. The case is affirmed in part, reversed in part, and remanded.
