Hearns v. Orleans Parish School Board
Citations: 464 So. 2d 865; 1985 La. App. LEXIS 8213; 23 Educ. L. Rep. 800Docket: No. CA 2305
Court: Louisiana Court of Appeal; February 11, 1985; Louisiana; State Appellate Court
Plaintiff's claims of pain and disabilities, although inconsistent regarding the constancy of pain, are sufficiently supported by medical testimony confirming a cervical disc injury. The trial judge's decision to award worker's compensation benefits for permanent partial disability is upheld, as the judge is given deference in assessing witness credibility. Despite the fact that the awarded benefits exceed 100% of the plaintiff's actual earnings due to her sporadic work as a substitute teacher, this does not undermine the validity of the award. The ruling is affirmed.
