Bianca Cole, a former government employee and contractor, filed a lawsuit against several defendants, including the Director of National Intelligence, the Director of the CIA, Booz Allen Hamilton Inc., CACI International Inc., and Perspecta/Peraton, alleging harassment and discrimination based on race, religion, color, gender, and national origin during her employment from 2014 to 2021. She sought damages of approximately ten million dollars, a retraction of false statements, and reinstatement or additional damages. The court noted that Cole had failed to serve Perspecta/Peraton, which she never served, despite being granted multiple extensions. The defendants, except Perspecta/Peraton, filed motions to dismiss, and the court warned Cole of the consequences of not responding. Ultimately, the court dismissed her claims against Perspecta/Peraton due to her failure to effect service within the required timeframe.
The Court has granted multiple motions to dismiss various claims made by Cole against several defendants. Firstly, Booz Allen Hamilton's motion is granted due to Cole's failure to respond, resulting in the dismissal of her claims against the company for failure to state a claim. Similarly, CACI International's motion is also granted, dismissing Cole's claims against it for lack of personal jurisdiction, again due to her lack of response.
Regarding the Federal Defendants, the Court assessed its subject matter jurisdiction, noting that the claims against them are barred by the United States’ sovereign immunity, except for claims under Title VII, the Equal Pay Act, and the Electronic Communications Privacy Act. However, Cole failed to respond to the Federal Defendants' motion as well, leading to the dismissal of these claims for failure to state a claim.
Additionally, the Court indicated that any remaining claims that could be construed from Cole’s complaint would also be dismissed for failure to prosecute, given her inactivity since February 2022. Consequently, the Court orders the following: 1. Dismissal of claims against Perspecta/Peraton for failure to serve; 2. Dismissal of claims against Booz Allen Hamilton for failure to state a claim; 3. Dismissal of claims against CACI International for lack of personal jurisdiction; 4. Partial dismissal of claims against the Director of National Intelligence and the Director of the CIA for lack of subject matter jurisdiction and failure to state a claim; and 5. The case is ultimately dismissed, rendering this a final appealable order. The Clerk of the Court is instructed to close the case.
