On April 30, 1996, the Fourth Circuit affirmed in part and reversed in part a district court decision that granted summary judgment to Medtronic, Inc. The case was subsequently taken up by the Supreme Court, which vacated the Fourth Circuit's judgment for further consideration in light of the Supreme Court's ruling in Medtronic, Inc. v. Lohr. After reviewing the Lohr decision and its own prior ruling in Duvall v. Bristol-Myers-Squibb Co., the Fourth Circuit chose to remand all five counts in Griffin's complaint for reconsideration under the standards established in Lohr and Duvall. The order was issued by Circuit Judge Michael, with concurrence from Judges Widener and Motz.
