The United States Court of Appeals for the Eleventh Circuit has ordered a rehearing en banc in the case of United States of America v. Barry Kaplan, originally decided on January 22, 1998. This decision follows a request for a poll by a member of the court, which resulted in a majority of active judges voting in favor of the rehearing. Consequently, the previous panel's opinion has been vacated. The case will be re-evaluated by the full court, comprising Chief Judge Hatchett and Circuit Judges Tjoflat, Anderson, Edmondson, Cox, Birch, Dubina, Black, Carnes, Barkett, Hull, and Marcus.
