Docket: No. 48S00-1311-DI-770
Court: Indiana Supreme Court; August 28, 2014; Indiana; State Supreme Court
A "Notice of Guilty Finding and Request for Suspension" was filed against the Respondent on November 26, 2013, leading to an interim suspension on February 26, 2014. The Respondent submitted an affidavit resigning from the bar, acknowledging the truth of the allegations and recognizing an inability to mount a successful defense if prosecuted. The Court accepted the resignation effective immediately and instructed the Clerk to record it on the Roll of Attorneys. Any pending disciplinary proceedings against the Respondent were dismissed as moot due to the resignation. The Respondent is barred from petitioning for reinstatement for five years from the date of this order, with the possibility of addressing admitted misconduct during the reinstatement process. Approval for reinstatement is at the Court's discretion and requires clear evidence of remorse, rehabilitation, and fitness to practice law. The acceptance of the resignation does not exempt the Respondent from civil or criminal liability for past misconduct. The costs associated with the proceedings are charged to the Respondent. The Clerk is tasked with distributing copies of the Order and publishing it as required. All Justices concurred, except for Justice Massa, who did not participate.
