A majority of the Judges in regular active service of the Court have voted to rehear the case en banc. Consequently, according to Sixth Circuit Rule 35(a), the previous opinion and judgment are vacated, the mandate is stayed, and the case is reinstated on the docket as a pending appeal. The Clerk will instruct the parties to submit supplemental briefs and will arrange for oral argument as directed by the court.
