Hobbs v. State Accident Insurance Fund
Citations: 47 Or. App. 1013; 615 P.2d 418; 1980 Ore. App. LEXIS 3276Docket: No. 79-1348, CA 16645
Court: Court of Appeals of Oregon; August 25, 1980; Oregon; State Appellate Court
The referee initially awarded the claimant 35 percent unscheduled disability, a decision upheld by the Workers’ Compensation Board. The claimant appealed, arguing for a determination of permanent and total disability or, alternatively, a higher percentage of permanent disability benefits. After conducting a de novo review, it was determined that the claimant is entitled to 50 percent permanent unscheduled disability. Consequently, the Board's order was reversed, and the case was remanded for modification to reflect the new award of 50 percent permanent unscheduled disability.
