Buster Joe Ball, a pretrial detainee, appealed the dismissal of his 42 U.S.C. Sec. 1983 action by the District Court for the Western District of Arkansas. Ball alleged that he was improperly denied the right to chew tobacco while other inmates and jailers were allowed to do so. The Eighth Circuit Court of Appeals, comprising Judges McMillian, Loken, and Hansen, reviewed the case and found that the district court's findings of fact were not clearly erroneous and that no legal errors were present. Consequently, the appellate court affirmed the district court's judgment.
