Ernest Leroy Burgess, the appellant, sought to appeal a district court's denial of his in forma pauperis status. The United States Court of Appeals for the Fourth Circuit reviewed the case, including the district court's opinion that accepted the magistrate judge's recommendation. The court found that the appeal lacked merit and, therefore, denied Burgess the ability to proceed in forma pauperis. The appeal was subsequently dismissed.
