Docket: 91-2417

Court: Ohio Supreme Court; June 13, 1996; Ohio; State Supreme Court

The court has granted the motion to stay the execution of the appellant's sentence pending the exhaustion of state post-conviction remedies. The stay is effective for six months, from May 8, 1996, to November 8, 1996, allowing the appellant time to file a petition for post-conviction relief. If the petition is not filed within this timeframe, the stay will expire with no further extensions granted except under unusual circumstances. Should the appellant file the petition within the allotted period, a date-stamped copy must be submitted to the Clerk of the court, and the stay will remain in effect until all state post-conviction proceedings, including any appeals, are exhausted. Compliance with the mandate and execution of the sentence is stayed for the specified six-month period and, if a petition is filed, until all related proceedings are resolved. Counsel for both parties are required to inform the court once all post-conviction proceedings have concluded.
