State v. Jackson
Citations: 62 Ohio St. 3d 1487; 582 N.E.2d 612Docket: 89-2128
Court: Ohio Supreme Court; December 23, 1991; Ohio; State Supreme Court
The court has granted a motion to stay the execution of the appellant's sentence for six months, effective December 23, 1991, to allow the appellant time to file a petition for post-conviction relief. If the appellant does not file within this six-month period, the stay will expire without further extensions unless unusual circumstances arise. If a petition is filed within the allotted time, the appellant must submit a date-stamped copy to the Clerk of the court, and the stay will remain in effect until all state post-conviction proceedings, including appeals, are exhausted. The compliance with the mandate and execution of the sentence is thus stayed for the specified period or until the resolution of post-conviction relief proceedings.
