Hayes v. Hobart Corp.
Citations: 7 Mass. App. Ct. 889; 387 N.E.2d 176
Court: Massachusetts Appeals Court; March 23, 1979; Massachusetts; State Appellate Court
The jury had the option to determine that the defendant was negligent in designing a food chopper that allowed users' fingers to easily reach the cutting blades, as supported by their examination of the machine and accompanying photographs. The jury could also conclude that the design was negligent based on the expert testimony presented by the plaintiff, which indicated that the machine was dangerous and that a safer design was feasible while still achieving the same functionality. The judgment in this case has been affirmed.
