An appeal and cross-appeal were filed regarding a September 4, 2013 order from the Supreme Court of Onondaga County, which partially granted the plaintiffs’ post-trial motion for a new trial against defendants Christopher LaRussa, M.D., and Associates for Women’s Medicine, PLLC. The appellate court modified the order by denying the post-trial motion in its entirety and reinstating the jury's verdict, affirming the modified order without costs. The case involved a medical malpractice claim by Mary Beebe, who suffered an infection following an emergency cesarean section performed by Dr. LaRussa, with Dr. Kavety responsible for her discharge and follow-up care. The plaintiffs alleged negligence by Dr. LaRussa for using single antibiotic prophylaxis instead of dual and for inadequate postoperative care, and by Dr. Kavety for discharging Beebe without proper inquiry into her condition. A jury trial concluded with a verdict finding no negligence on the part of either doctor. The Supreme Court initially set aside this verdict, prompting the appeal. The appellate court found that the trial court erred in granting the motion concerning Dr. LaRussa, particularly regarding the jury being instructed on an error in judgment charge and that the verdict was against the weight of the evidence. The court emphasized that Dr. LaRussa acted within acceptable medical practices and that the jury’s verdict was justifiable. On the cross-appeal, the court upheld the denial of the motion concerning Dr. Kavety, affirming that an error in judgment charge was appropriate for her actions during the discharge and follow-up. The verdict in favor of Dr. Kavety was also supported by a reasonable interpretation of the evidence. The decision was made by Justices Centra, Garni, Valentino, and Whalen.
