On October 7, 1994, the Supreme Court of New York County, presided over by Justice Joan Sudolnik, convicted the defendant of criminal sale of a controlled substance in the third degree following a jury trial. The defendant, classified as a second felony offender, was sentenced to a prison term of 4½ to 9 years. The appellate court unanimously affirmed the conviction, finding that the evidence presented at trial was legally sufficient and not contrary to the weight of the evidence. The court determined that issues regarding the credibility and reliability of identification testimony were appropriately assessed by the jury, and there were no grounds to alter the jury’s findings. Justices Sullivan, Milonas, Rosenberger, Ellerin, and Wallach concurred with the decision.
