In re Gregory
Court: Appellate Division of the Supreme Court of the State of New York; January 20, 1997; New York; State Appellate Court
The court found respondent Milan Kenneth Gregory guilty of 12 allegations of professional misconduct, all sustained by the Special Referee due to the respondent's failure to answer the petition or appear at the hearing. The first six charges were based on his lack of cooperation with the Grievance Committee regarding six separate complaints. Charge Seven involved his failure to pay a $1,000 judgment in favor of a client. Charge Eight pertained to his failure to communicate with a client about case status. Charge Nine involved a dishonored $10,000 repayment check issued to a former client. Charge Ten addressed a check written against his escrow account that was returned for insufficient funds. Charges Eleven and Twelve related to his failure to return escrow funds and a client’s check totaling $2,159.98, respectively, both violations of the Code of Professional Responsibility. The court confirmed all allegations as established due to the respondent's default, referencing prior case law. Consequently, Gregory was disbarred, with his name struck from the roll of attorneys. He is ordered to comply with rules governing disbarred attorneys and is prohibited from practicing law in any capacity or presenting himself as an attorney.
