The petition for rehearing en banc filed by the appellant has been granted following a majority vote by the judges of the court. Consequently, the opinion and judgment dated July 16, 1998, have been vacated. The Clerk is instructed to schedule oral arguments before the en banc court at the earliest opportunity. The parties are required to submit new briefs by February 1, 1999, specifically tailored for the en banc court, addressing both the majority and dissenting opinions from the previous division. These new briefs will replace, rather than supplement, the earlier submissions. Each party must provide ten copies of their brief. Additionally, responsive memoranda may be filed by no later than February 15, 1999.
