Zeus Realty Co. v. Muratore Realty Corp.
Docket: Nos. 94-1-A to 94-3-A and 94-8-A
Court: Supreme Court of Rhode Island; November 28, 1995; Rhode Island; State Supreme Court
A hearing panel addressed the defendants' appeal regarding orders that foreclosed their rights of redemption in four consolidated cases. The defendants had been granted the opportunity to redeem four parcels sold at tax sale by making payments in three installments, as ordered by the Superior Court on November 19, 1993. Should they fail to make payments, the order stipulated that judgment foreclosing their rights would be automatically enforced. The defendants defaulted on the first payment, leading to a final decree of foreclosure on December 10, 1993. They subsequently filed motions to vacate this decree, which were denied after the court reviewed conflicting affidavits. The trial judge found the defendants' reasons for non-compliance to be incredible and did not identify any errors in the decision-making process. Consequently, the decision to deny the motions to vacate was affirmed, and the defendants' appeal was denied and dismissed. Chief Justice Weisberger did not participate in the proceedings.
