The United States Court of Appeals for the Fifth Circuit has granted a suggestion for rehearing en banc in the case Equal Employment Opportunity Commission v. Mississippi State Tax Commission, with the original decision dated June 21, 1988. The panel included Chief Judge Clark and Judges GEE, RUBIN, REAVLEY, POLITZ, KING, JOHNSON, WILLIAMS, GARWOOD, JOLLY, HIGGINBOTHAM, DAVIS, JONES, and SMITH. A majority of the judges in active service voted in favor of the rehearing, which will include oral arguments scheduled for a future date. The Clerk of the Court will issue a briefing schedule for the submission of supplemental briefs.
